Terms of Service

By signing up for or using On PH ("the Service"), you agree to these Terms. If you do not agree, do not use the Service.
1. Description of Service
On PH provides subdomain landing pages (yourbusiness.onph.online) with AI chat widget, booking calendar, and email notification features for Philippine businesses.
2. Account Registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your password and for all activities under your account. Notify us immediately at [email protected] if you suspect unauthorized use.
3. Fees & Payment
3.1 Subscription
The Service is billed monthly at the rate displayed on our pricing page (currently ₱1,500/month). The first 14 days are free — no credit card required during the trial period.
3.2 Setup Fee
A one-time setup fee of ₱2,000 is due before activation. This covers configuration and deployment of your subdomain page.
3.3 Payment Terms
Payment is due within 7 days of invoice. Late payments may result in service suspension. Accounts more than 30 days overdue may be terminated.
3.4 Price Changes
We may adjust subscription fees with 30 days' written notice. You may cancel without penalty within the notice period if you disagree with the change.
3.5 No Free Tier
On PH does not offer a permanent free tier. All accounts convert to paid subscription after the 14-day trial period.
4. Term & Termination
4.1 Term
This agreement is month-to-month. No long-term contract required.
4.2 Cancellation
You may cancel anytime with 30 days' notice. Upon cancellation, your subdomain page will be taken offline at the end of the notice period.
4.3 Data Export
Upon request within 14 days of termination, we will provide a copy of your booking records in CSV format. After 14 days, your data is permanently deleted.
4.4 Suspension
We may suspend service for non-payment or violation of these Terms. Fees continue to accrue during suspension. Data is retained until payment is settled or 90 days, whichever comes first.
5. Client Responsibilities
- Provide accurate business information for your subdomain page
- Respond to booking requests from your customers in a timely manner
- Not use the Service for illegal activity, fraud, or harassment
- Not attempt to reverse-engineer, scrape, or abuse the AI chat system
- Review AI chat responses and report recurring issues within 48 hours
6. AI Chat
The AI chat widget is provided as a tool to assist your business operations. It is not a replacement for human judgment. We make no guarantee about the accuracy, completeness, or appropriateness of AI-generated responses. You are responsible for reviewing and moderating AI interactions on your page.
Conversations are processed through third-party AI providers (currently DeepSeek, hosted in China). By using the Service, you consent to this data processing. See our Privacy Policy for details.
7. Limitation of Liability
The Service is provided "as is" and "as available." To the fullest extent permitted by Philippine law:
- Our total liability is limited to the total fees paid by you in the 3 months preceding the claim
- We are not liable for indirect, incidental, or consequential damages
- We are not liable for downtime caused by third-party services (Cloudflare, DeepSeek, internet infrastructure)
- We are not liable for content generated by the AI chat system
8. Service Level (SLA)
We target 99% uptime for subdomain page availability, measured monthly. If uptime falls below 99%, you may request a service credit of 10% of your monthly fee per full percentage point below the target, capped at 50% of the monthly fee. Credits must be requested within 48 hours of the outage.
Excluded from uptime calculation: planned maintenance (48 hours' notice), third-party API outages, force majeure events.
9. Data & Privacy
Our Privacy Policy is incorporated into these Terms by reference. You own all business data and customer information submitted through your page. We will not use your data to train AI models shared with other clients.
10. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Republic of the Philippines (RA 386, RA 10173, RA 8792). Any dispute shall first be submitted to mediation for 30 days. If unresolved, the dispute shall be brought before the courts of Muntinlupa City, Philippines.
11. General Provisions
- Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement between you and On PH
- Severability: If any provision is found unenforceable, the remaining provisions remain in effect
- No Assignment: You may not transfer your account without our written consent
- Changes: We may update these Terms with 14 days' notice via email
